رغبة المالك في معاينة العقار لبيعه بينما يرفض المستأجر

لقد جددت للتو عقد الإيجار الخاص بي، وفي الوقت الحالي أبلغتني صاحبة العقار أنها تريد بيع الفيلا وتريد من وكيلها ترتيب موعد لمعاينتها.

أنا أعمل من المنزل ولديّ طفل ورضيع في المنزل. نتوخى الحذر الشديد بسبب الوباء ولست مرتاحًا للغرباء الذين يدخلون ويخرجون من المنزل أثناء فيروس كورونا، ما هي حقوقي؟

لا يوجد شيء في العقد يتعلق بالمبيعات أو المعاينة.

Dear questioner,

First of all, you can ask your landlord or her agent to make virtual viewing by any APPs to close their argument in this regard, especially if the terms and conditions in your tenancy contract do not stipulate that you have to allow the landlord to view the villa.

Furthermore, that the transfer of title to a new landlord shall not affect the tenant’s right to continue the occupation of the villa in accordance with the tenancy contract signed with the previous owner, provided that the tenancy contract has a fixed date.

Moreover, the landlord cannot do anything which disturbs the tenant in his enjoyment of the leased property during the period of the lease, otherwise, he shall be held liable according to article No. (770) of the Civil Transactions law.

Thank you very much Anwar for the information provided.

My current contract expires at the end of June 2022, assuming she sells the villa sometime this year and the new owner wants to live in it, can they just kick me out when my contract expires? or do they need to serve me a 1-year notice as a new landlord that they intend to live in it?

They must serve you one year notice before evacuation.
