إجبار موظف على قضاء فترة إشعار مدتها 6 أشهر

إنني أعمل في إمارة دبي بصفتي مدير في إدارة المرافق منذ 16 عامًا. لقد حصلت في الوقت الحالي على وظيفة حكومية في دولة الإمارات وقدمت استقالتي مع فترة إشعار مدتها شهر واحد.

رفض صاحب العمل قبول استقالتي وطلب مني تقديم فترة إشعار مدتها ستة أشهر. ستنتهي تأشيرة إقامتي بعد 65 يومًا من تاريخ استقالتي.

أقنعت صاحب العمل الجديد بالانتظار حتى انتهاء تأشيرتي. ولكن هددني صاحب العمل الحالي بأنه سيرفع قضية ضدي لتأخير إلغاء التأشيرة حتى يمنعني من الانضمام للعمل لدى الشركة الجديدة.

يرجى تقديم المشورة لي بشأن ما يمكنني فعله في هذه الحالة.

Dear questioner,

The notice period mentioned in your Labor Contract is what must be served.

The employer cannot force you to serve more than what is mentioned on the Labor Contract.

As per your query, please note that there can not be 6 months notice period. It seems that the employer is actually delaying the payment for your EOSB.

You may complain to the labor or you may primarily go for settlement with your company.
