ماذا يحدث في حالة إنهاء عقد عمل محدد المدة قبل انتهاء مدته؟

مرحبًا سيدتي،

لقد وقّعت عقد عمل محدد المدة بدايةً من 31 يناير 2020 وحتى 30 يناير 2022. لقد أكملت الآن سنة واحدة وخمسة أشهر.

يرجى تقديم المشورة لي بشأن الأمور التالية:

1. هل يمكنني الاستقالة من وظيفتي الحالية؟

2. هل سيقوم صاحب العمل بفرض حظر عليّ، حتى بعد إكمال سنة وخمسة أشهر في الخدمة؟

3. إذا قام صاحب العمل بفرض حظر عليّ، ما الحل لرفع الحرمان والعمل لدى شركة أخرى (في داخل الدولة)؟

Dear Questioner,

Since yours is a limited contract you have a legal obligation to compensate the employer by paying him not exceeding 45 days of your wages. This is compensation for the early termination of a limited contract.

In addition to the above, if you are not willing to serve a notice period prescribed in the employment contract, you shall compensate the employer with compensation in lieu of the notice period.

The above is not applicable if you are serving the notice period. If you comply with the requirements there will not be a ban imposed on you.

If found otherwise at a later stage, you may request the ministry to lift it by submitting proof of your compliance with the legal provisions.
