Q: Hi,
Last September I filed a case against my employer as he hasn’t given any of my settlement after my 2 years of service in their company.
However, last November 2018 the court ruled in my favour, and up to date, I haven’t received any call from my previous company.
Yet, I’m trying to file for execution but this typing centre keeps telling me to come back after a week which is illogical for me because it’s been 2 months since I received the court decision.
By this time, I should've already received the settlement.
What advice can you share with me to make the process faster as I’m planning to return to my home country?

Q: I have opened an execution file on 6 September 2020 against my company after 11 months of a case. They didn’t pay my final settlement, my court judgement was declared in January 2020.
I visited Al Adheed Center last month and they sent some requests to the court in which they demanded on my behalf license suspension and some similar charges.
But I came to know that my company owners have changed their license and they didn’t renew the old license, which means whatever Al Adheed Center requested on my behalf to the court and whatever decisions the court is taking was on the expired old license.
Please, can anyone tell me whether the old license is still effective or not because I’m still on my company’s old license visa?
What’s the next procedure?

My problem is I filed a labour case against our old company. I have a final judgment.
Now I applied for execution. But I am still not taking my final settlement! The court gives me every time a new date.

Can I take my passport and follow up my labor case execution from outside the country?

Q: My company was not paying 6 months salary. Now the final judgment that was in our favor also finished 15 days and today I applied for execution.
What should I do now?
I want to go back to India my visa is finished this 31 Dec 2021. I want to continue my case when I am outside the country if possible.
The company is not giving me the passport.
Please suggest.

Q: Hi,
I filed a case against my company for not paying my settlement dues in spite of waiting for 5 months after my termination.
The labor court has decided in its judgment on a claim amount of DHS 20000 as my settlement dues.
The company did not bother to either receive any call from MOHRE and subsequently did not attend the remote hearing in the courts as well.
Now, my question is that if the claim amount is 20,000 Dhs as decided by the court, what is the procedure to notify the company about this judgment?
Will the court notify the company of its judgment or is there any other process to be followed by me to do the same?
Secondly, as I understand, the company cannot appeal the judgment if the claim amount is below 20,000 Dhs.
In such a scenario, if there's no appeal, what's the timeframe within which the company adheres to this ruling by the court to pay off the dues?
And can they explore the option of paying the dues in installments to delay further?

I recently purchased a property in Springs which is rented till September. I need legal advice on the procedure to send an eviction notice to my tenant as I need to occupy the property for personal use.
As far as I read in the RERA legislation Page 108-110, Article (25) - Section - 2, if the landlord wants to occupy the property for personal use, 90 days notice is sufficient.
But the tenant insists to have a 12-month notice. What are my options and is it possible to send a legal notice to the tenant to vacate the premises at the end of the rent contract?

Greetings,
The property was supposed to be delivered in June 2018 and is still not delivered. If they actually deliver by June 2021, what are my rights to the compensation?
At the time of purchase, it was a 50-50 payment plan. I paid the 50% at the time of purchase and in September 2019 they came back to me with an offer of a discount of 16% in the final settlement amount.
I accepted and paid the remaining amount as well. Therefore as of September 2019, I have paid 100% of the property value.
With all the financial challenges the delay has brought me into, I want to know what compensation is my right as I am assuming they will not be offering anything or if they do they might offer some waiver in service charges (for 1 or 2 years).
And I am worried if they give this waiver of service charges to everyone, will the property be actually taken care of or no?

Hello,
I am originally from the UK and relocated to Dubai in 2004 when my company established a new office.
I originally joined the same company in 2001, based in the London office. Since then, I have grown with the organization and am in a middle management role.
Recently, the company announced they would downsize the Dubai office, and affected staff would be offered to relocate back to an office in their home country (India) or to the new office being established in Spain.
I have been advised that my present role will be made redundant in Dubai but have been offered a new role in Spain. The new role is seen as a promotion but there are little to no benefits and it's a major drop in salary (basic salary would drop by 40%).
There are no additional allowances. Currently, I receive basic salary + allowances.
I have been in the UAE since 2004 and my options appear to be limited to accept redundancy or a new role with a significant drop in salary. Would this be considered constructive dismissal?

Right of the seller to claim the deposit from the buyer for breaching the MOU 0
Hello,
I have signed an MOU where the buyer failed to complete the transaction as per the date of transfer plus the extension. Thus, the MOU expired. I have requested from the agency the 10% deposit cheque signed by the buyer.
They refused to give it to me and requested an extension without any penalties or price increase despite the market appreciation by 10%. What can I do to get the cheque legally from them?
I am already in a big issue because I already bought a bigger unit having in mind that my unit is sold. They are asking for an MOU extension but the prices went up and I request the fair price as per the market and they are refusing to pay the increase.
Appreciate it if somebody can provide me with feedback on these two points:
1- Can the agency hold the cheque and not give it to me? Aren't they violating the law here?
2- What can be done in this case and what would the next steps be?
