Q: Dear Sir,
I am working in a Hospital as a Registered Nurse from 11.05.2014.
My first two labour contracts were unlimited labour contract and after finishing the second contract term, the hospital management renewed the labour contract with a new limited labour contract.
I have resigned from the hospital now and I am in the 2 months notice period as per contract. I like to know about the calculation of my gratuity amount.
As per the hospital management, they calculate the gratuity as 14 days x 4 years (for the completed unlimited contract period).
Whereas I have completed total 5 years and 4 months period in total with the hospital (4 years with unlimited contract and 1 year and 2 months with limited contract).
Kindly confirm this gratuity calculation is correct as per the UAE labour law.
Also, the hospital management asked me to pay a two-months full salary as a penalty since I am resigning without completing the limited contract.
I am awaiting your valued reply.

Good evening,
Initially, I was being appointed in a Dubai-based company and they transferred me to Qatar.
I worked 10 years in Qatar and again they transferred me to Dubai and I worked for 3 years. Then after that, they transferred me to owners' personal company in Dubai and I worked for 5 years.
I worked for a total of 18 years but my EOSB was never settled. Now, I got terminated and my present basic salary is AED 10,000/-.
How will my EOSB Gratuity calculation be?
Please help me understand.

How will the gratuity be calculated if the company changed my contract and salary?

1
Q: Dear Sir,
I started to work in a company on 28-Feb-2012. In 2014, due to a change in the name of the company/license, they canceled the visa and gave me a new visa to continue. While they changed my visa, they gave me 2 years of gratuity/EOSB.
After that, in June 2020, my package was changed due to a specific contract & accordingly, the MOL contract document was changed for visa processing. The changed package is more than previous.
Now I have resigned, Please advise;
1. What will be the timeframe to calculate the EOSB (from 2012 or 2014)?
2. Would I receive a gratuity based on my current basic income for the whole year of service (2012/2014 to 2023 Sep.) or my previous pay scale (up to year 2020) & 2020 to now with my current pay scale?

Filing a complaint against a company after withdrawing a job offer 0
I signed an offer letter and a copy of a contract in a company located in Dubai Design District.
I resigned from my current company located in Jebel Ali and will be ending my noticed period on April 4, 2021.
Now the new company is really unclear about when I can start joining them. If the company does not pursue my hiring, but I have already resigned and lost my job, are there any legal complaints and claims I can file?

The consequences of changing the nationality of an ex-pat 0
I have a working visa in the UAE. I have decided to apply for an EU passport.
Once I receive it, I need to surrender my original passport to the consulate since my country does not allow dual nationality.
I will be informing my company HR about this. I would like to know:
1. Can the company terminate me since I have joined under a different nationality?
2. What will happen to my end-of-service benefits?
3. Do I have to undergo a medical test, get a new Emirates ID, update my bank accounts, phone registration, and other documentation?
4. Anything else to be done?

The rights and obligations of a freelancer regarding gratuity and non-competition 0
Good afternoon.
The company terminated my unlimited full-time employment contract after 3 years, so not renewing my visa. I am working on my own visa now and continue as a freelancer.
But they want me to sign their freelance/consultancy agreement with a clause that I am not allowed to work for any of their competitors (but they don't provide me with a visa, medical, no benefits, even not giving me enough working hours).
1) Is it legal to ask a freelancer for this exclusivity?
2) How I can be a freelancer and not allowed to work for other companies?
3) What shall I do if I still want to continue working with them but need other jobs in other companies to have enough income to pay my bills?
4) Am I entitled to gratuity? Because they didn't mention it.
Thank you

How can I return to the UAE if I got blacklisted for an unpaid loan? 0
Dear All,
I am wondering what if someone took a loan and left the UAE because of work loss (redundancy matter) for months and got blacklisted.
He got a job offer in UAE again and wants to go back and pay all his debt. Will that be possible? Can the ban be lifted? Or what should be done in this case?
Thank you
