حالة التأشيرة عند انتهاء عقد العمل قبل تاريخ انتهاء التأشيرة

مرحبًا سيدي،

إنني أعمل لدى شركة خاصة في إمارة الشارقة. عقد العمل الخاص بي محدد المدة. سينتهي العقد في 22/05/2021 لكن تأشيرتي ستنتهي في منتصف شهر يوليو 2021، وبالتالي سيكون تاريخ انتهاء العقد هو 22/05/2021.

إذا تركت هذه الشركة وقدمت استقالتي، هل سأحصل على كافة مستحقاتي (مثل مكافأة نهاية الخدمة وراتب الإجازة وتذكرة الطيران)؟ هل سأواجه أي مشاكل قانونية؟ هل يجب عليّ الانتظار حتى شهر يوليو حسب تاريخ التأشيرة؟

Upon termination of employment, a residence visa has to be canceled on the last day of work; after all employment benefits have been paid out.

The employee has one month's grace period after visa cancellation to exit the country.

The Immigration Authorities, nevertheless, do allow companies to keep staff on the visa for a longer period but this is subject to limitations.

In other words, this privilege is given provided it is used for only a specific number of employees.

Speak to your employer again in a nice way, explain the difficulties you will have if your visa is canceled immediately.

An extension is done on a trust basis as technically, you will still be their responsibility, albeit not working at their premises.
