Q: I am working in DMCC. My company is not paying my correct end of service nor unclaimed leave salary nor notice period.
Also, they deducted 2000 per month for 7 months saying it's cost-cutting which I never accepted, and they said they will compensate later.
Which court do I need to approach if mediation there fails and what are my rights? Is the mediation not able to tell that too there?

Claiming EOSB after resignation from unresponsive employer

Q: I have resigned from my previous employer on 11 February 2020. I worked with the company for 10 years now.
The company owes me a gratuity amount of AED 90,000. They earlier assured me they would pay my end of service in part.
However, they have been ignoring my emails, phone calls, Whatsapp messages...etc. It's been almost more than 45 days now.
Can someone let me know how can I proceed legally with this and will I get my end of service?
They have been doing this to other previous employees and don't care about the UAE law. It's a free zone media company in Abu Dhabi.
Please help.

Signing the EOSB paper after resignation to get cancelled

Q: I got a new job in Dubai and I resigned from my current company in Dubai. There is a salary delay of 3 months in my current company. I have a few questions to ask.
1. My company stopped processing my pending salaries once I resigned. As per them, all the pending salaries will be paid along with final settlement only. Is it legal?
2. If I am signing the end of service document to cancel my contract before getting the settlement, can I move legally later if they are delaying the final settlement further?

Q: Hi,
I need advice on my end-of-service benefits. I have been working with an employer in Abu Dhabi for the last 2 and a half years.
I recently resigned from my position and successfully completed my 2 month notice period on the 14th of August. Since then, the employer has not released my dues which were agreed on my last working day.
Actually, they are forcing me to sign the cancellation paper before clearing any dues which I have refused as the cancellation paper clearly states that "I certify that I have received all of my dues".
I have requested them multiple times over email and phone but still, they are giving invalid excuses and doing unnecessary delays.
Can you please guide me on how I can tackle this situation as I urgently need to return to my country?
I want to leave on happy terms without having any clashes at this stage.
Please advise.

An employer refuses to give an employee his labor dues after waiting for 6 months

Q: Dear sir/madam,
I served my 2 months notice and resigned on the 12th of August as I was supposed to leave the country on the 14th of August during peak COVID time with my dependents.
However, I had to ask for a 1-month extension which would be served with my annual leaves as during peak COVID times, the flights would get canceled without notice. My manager and the HR were kept in the loop and my HR sent me a work permit cancellation letter which I signed and submitted upon confirmation from my manager.
Later when I enquired, my HR said that I am absconding and would receive my settlement after 6 months so I waited. Now after 6 months, on inquiry, HR calls my manager and asks him to inform me that I won't be paid anything as I am absconding.
Now my question is when I have kept everyone in the loop, my manager, the HR with all the steps, how can I be declared absconding.
I have all the emails and chats as proof and would like to know where do I stand legally?

The employer refuses to implement the settlement. What to do?

Q: Hi,
I had an issue with an employer so I had complained to MOHRE and we came to an agreement of settlement with MOHRE presence.
Now the employer is refusing to implement the settlement and I reactivated the complaint. As per MOHRE, they say that there was no such agreement but I have a recording of the conversation as proof.
Can I submit this as proof to the court?
Kindly advise!

Our internal contract has a notice period of 3 months from both parties. In the new labor implementation, only one month's notice is required for less than 5 years of service.
Please advise if we can follow our internal contract since the position is very curtailed and the organization will not be able to replace the position within one month.

Annual leave salary calculation as per the new labor law.
Can you please clarify the correct annual leave salary rules?
Some say it is basic + HRA for the month you will take off, others say it is full salary, and somewhere I read it is basic + HRA (annual leave salary) plus the normal salary you get.

How to appeal the labor judgment if the court did not approve all my dues? 0
My employer has not paid my salary for 8.5 months. I went to the labor court, and was referred to Dubai Courts.
The judgment came and I did not receive the full claim including salaries and 3 months' compensation.
