Visa issues after serving a jail term
Hi! My brother is in UAE. He was in the prison for the last 8 months for cheque cases. Now all his cases are finished. But his VISA is expired in April 2015. He doesn't have his passport with him.
What to do for bringing him to India?
It is suggested within the question facts that all cases have been completed. It is first necessary to confirm that all proceedings from both a civil and criminal perspective have been concluded as both could attract penalty inclusive of imprisonment and thus prevent departure from the UAE. To further advise sight of paperwork would be required.
Re the Visa. It would be necessary to contact Immigration to see the nature of the visa held, if any cancelation has been effected and to check with The Ministry of Labour to see if any absconding case has been filed. The period of time in custody could partially cover some of the period by obtaining A Certificate from the Police confirming time spent in custody but no visa from 2015 would require further explanation.
