How to make loan settlement with the bank to avoid a civil case

Dear Legaladvice Me,

I have a personal loan of 28k and accrued to almost 50k currently that was not paid for almost 2 years now. The bank has already bounced the cheque and fine has been paid.

In relation to this, I have questions

Will the civil case likely happen? Is it better to wait for the civil case or negotiate with the bank as I believe it is still can be negotiated through court?

I have been trying to ask for a discount but the bank is not refusing to.

Dear Questioner,

Please be informed that the bank will file the civil case against you as soon as possible if you did not settle this issue with them.

Based on our history, most of the banks refuses any type of discount.

Dear Questioner,

I would suggest before you start the negotiations with the bank to hire a lawyer to check your civil records to see if the bank has already filed a case against you.

If they did not file any civil case against you, I would suggest you start the negotiations with them. If they are not willing to negotiate, you have to pay the full amount.

However, please make sure you will not advance any payment before you sign a settlement letter with them, to protect you from future lawsuits.
