Q: Hi,
I need some help in understanding Dubai employment laws in hiring expatriates. We are an Indian based parent company, and we have a legal subsidiary in Dubai.
Lately, we are exploring the South African market and we would like to hire a local person in South Africa. However, We don’t have a legal entity in South Africa.
We are exploring an option where an employee can be governed by Dubai payroll but he/ she will be delegated to South Africa (Employee will get benefited in this case as he/ she gets ESOPS/ RSUS as we have a legal entity here in Dubai).
I have following questions:
Is it a smooth option to explore? (If we want to make a South African national as Dubai entity employee but delegated to South Africa).
What's the detailed process to put him/ her on the payroll (Visa, registration...etc.).
I highly appreciate your inputs in this regard.

Applying the UAE labor law to an employee working in a branch of a foreign company

Q: Dear All,
I have been working for an Indian based IT company for the last 7 years. In the last 3+ years, I was working in the UAE through their UAE branch. Now I have resigned for another job.
Which policy would be applied for my resignation?
Indian policy (90 days Notice Period) or UAE (Limited Contract)?
If the UAE policy is applicable, what would be the best option to serve 30 days notice period?

Validity of the employment contract if based outside the UAE

Q: Hi,
I was employed by a DMCC business but was based overseas (in Australia), not working in the UAE.
My employment contract was not registered with DMCC or MOHRE and I am looking to confirm what specific law requires UAE businesses to register employee contracts.
Is this requirement applicable to workers based overseas?
I'm in dispute with my employer and have been advised that my employment contract is not valid due to it not being registered.

Calculation of gratuity when the current salary is not the same as the salary in the contract 0
My employer put my salary in the agreement as 800 AED since 2012 and still the same. But, my present salary is 2000 AED.
Q1: How they will pay my gratuity if I cancel my visa from the company? According to my agreement salary or my present salary?
Q2: If they hold my passport after canceling my visa, then what can I do?

I signed an offer letter and a copy of a contract in a company located in Dubai Design District.
I resigned from my current company located in Jebel Ali and will be ending my noticed period on April 4, 2021.
Now the new company is really unclear about when I can start joining them. If the company does not pursue my hiring, but I have already resigned and lost my job, are there any legal complaints and claims I can file?

The consequences of changing the nationality of an ex-pat 0
I have a working visa in the UAE. I have decided to apply for an EU passport.
Once I receive it, I need to surrender my original passport to the consulate since my country does not allow dual nationality.
I will be informing my company HR about this. I would like to know:
1. Can the company terminate me since I have joined under a different nationality?
2. What will happen to my end-of-service benefits?
3. Do I have to undergo a medical test, get a new Emirates ID, update my bank accounts, phone registration, and other documentation?
4. Anything else to be done?

The rights and obligations of a freelancer regarding gratuity and non-competition 0
Good afternoon.
The company terminated my unlimited full-time employment contract after 3 years, so not renewing my visa. I am working on my own visa now and continue as a freelancer.
But they want me to sign their freelance/consultancy agreement with a clause that I am not allowed to work for any of their competitors (but they don't provide me with a visa, medical, no benefits, even not giving me enough working hours).
1) Is it legal to ask a freelancer for this exclusivity?
2) How I can be a freelancer and not allowed to work for other companies?
3) What shall I do if I still want to continue working with them but need other jobs in other companies to have enough income to pay my bills?
4) Am I entitled to gratuity? Because they didn't mention it.
