كيفية رفع المنع من السفر الصادر من المحكمة عن طريق الخطأ بسبب شيك ضمان

أصدرت محكمة التنفيذ في دبي حكمًا ضدي برد شيك. تم إصدار هذا الشيك في معاملة مدنية تم إلغاؤها بالفعل.

كما أن الشيك منتهي الصلاحية بالفعل. لكن محكمة التنفيذ أصدرت قرار بمنعي من السفر حتى أقوم برد هذا الشيك.

الحقيقة هي أن هذا الشيك تم إصداره باسمي ولكن تم إعطاؤه إلى وكيل العقارات من أجل الاحتفاظ به، ولم يتم تسليم الشيك إليّ، ولا أملكه.

كيف يمكنني الآن إزالة قرار المنع من السفر الصادر ضدي؟

هل من الشائع أن تصدر محكمة التنفيذ أمرًا بالمنع من السفر في مثل هذه الحالات على الرغم من أن المحكمة لم تعتبرني مسؤولاً من الناحية المالية أو الجنائية عن أي شيء؟

I think you misunderstood the situation. This was never a criminal case at all.

In 2019, the cheque in question was issued during the signing of an MOU for a property sale. The Seller issued the cheque in my name (I was the BUYER) as a security cheque.

But the Seller did not give me the cheque in my hand, instead, the real estate agent took the cheque and kept it with him for safekeeping until the sale of the property is completed.

However, the sale did not take place later and the MOU was annulled. The Court ordered that even though I am not buying the property any more, I do not have to pay any money to the Seller.

Instead, the Court said that my only responsibility is to return the Seller's cheque to him. Later, the Court issued a Travel Ban in my name saying that the travel ban will be lifted when I return this cheque to the Seller.

Please note that:

1) The cheque was dated in 2019 so it is already expired, which means that it is a valueless piece of document

2) The cheque is with the agent, not with me, so how will I return something that I never had with me?

Now, my question is that how will I apply to the Court to remove this travel ban?

Also, I hear that travel ban is usually issued for criminal, financial or labour cases.

Is it common for the travel ban to be issued for a piece of expired document like the one in my case?
