Can the employer hold my passport and ask for compensation if I resign?

Good day,

I left the job one year ago with the consent of my employer but they have my passport and not cancelling my visa.

They are asking me to pay them AED 10 for not finishing the contract and worked only for 8 months.

Please let me know what action should I take to make myself legal or come back to my home country.

Dear Questioner,

Thank you for contacting me.

I assume you are under a limited contract. In that case, you shall pay an amount equals to 45 days of your salary to your employer as compensation for the termination of the limited contract.

If it is an unlimited contract you shall give a notice period of 30 days when resigning or termination of the contract.

However, in both cases, your employer has no right to hold your passport. You may contact the nearest police station and also report the same to your embassy in the UAE.
