Q: Our tenant has requested an early termination of their contract on our property in Dubai. The agreement provides for a penalty of two months on early termination. However, the real estate agent managing the property on our behalf is unwilling to pursue this with the tenant. Further, they are refusing to give us a pro-rata refund of the management fee.
How can we enforce the contract with the tenant in regards to the early termination penalty and what rights do we have to recover a proportion of the management fee?

Q: Sir, I have taken an office in Dubai for three years starting from 1st April 2015 to 31st March 2018. Due to slow business conditions, I am forced to reduce expenses and planning to vacate current office and move to a smaller one. Unfortunately, there is no early termination clause in the lease agreement.
Please advise what is the penalty in such cases as per government law.

Q: Hi,
We just received our eviction notice from our Landlord for next summer 2018. We, however, would prefer exiting earlier.
In our current lease contract, we have the following clause: "The Parties agree that there may be instances where the tenant shall need to terminate the lease early. In this event, and in accordance with the current guidelines, the tenant must provide the landlord with a written 2 months of notice. The landlord agrees to refund any outstanding rental amount."
Kindly can you confirm the below:
This means that we still get to stay in the house for the 2 month notice period and there is no penalty charge.
The date on the letter is the 1st day of the 2 month notice period (notice given 23.08.2017, out by 22.10.2017).
Do we need the written notice to be notarized or does an emailed letter suffice?

Should I pay two-month rent penalty in case of early termination of my tenancy?

Q: Hi.
I am a tenant and gave notice to my landlord on 3rd July 2017.
The contract was for 12 months starting March 2017 but had the following provisions:
"The Parties agree that there may be instances where the Tenant shall need to terminate the lease early, and in accordance with current guidelines the Tenant will give a two-month notice and two-month rent penalty in the case of immediate vacation."
The landlord did not come to the pre-agreed date of vacating the premises on the 7th of September because I refused to pay him the two-month penalty, although I had already given him over 2 months notice.
He is saying I have to pay him the additional 2 months even though I read it as only payable if I vacated immediately.

Termination of a tenancy contract before its due date by a tenant

Q: Hello,
I'm the landlord of a flat in Dubai. I have rent out it to a tenant from 01/08/2019 to 31/07/2020.
The tenant has paid all with 2 checks. On 05, February, he told me that he wants to early terminate the contract and leave the flat on 05, April. In our addendum, it is written that:
18. In the event of termination of contract prior to the mentioned date of expiry, the tenant will have to inform the landlord with a 60 days prior written notice and indemnify the landlord with an amount equivalent of 2-month rent.
I understand that for sure he has to pay normal rent until 05, April and after that, he has to indemnify me with an amount like 2 months of penalty.
He understands that he has not to pay a penalty. Only stay until 5, April and leave.
What do you think about this?
In my opinion, "indemnify" means that he has to pay a penalty for my loss (the flat is empty, etc).

Tenant wants to leave apartment early after eviction notice: Is he entitled to a refund?

Q: Dear Sir/Madam,
I am in the process of selling an apartment that is tenanted until February 2024. In April 2023, I served the tenant with an eviction notice due to my plan to sell, which means he has until April 2024 to leave the apartment.
The contract stipulates that he is liable for two months' rent for early termination.
The tenant has informed me that he wishes to leave immediately and is demanding a refund of rent paid for the entire remaining period of the contract.
He claims that, according to the DLD, he can leave with no notice and without any penalty due to the eviction notice. Is he correct?

I am living in a flat with a contract ending in November, and my landlord sent me an eviction notice last March. I now wish to leave the flat in August.
Can I leave the flat before the end of the contract based on the eviction notice, or do I need to give 3 months' notice?

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
