ما هي رسوم السوق للوسيط عند بيع عقار في دبي؟

لقد اتفقت من خلال وسيط عقاري على بيع عقار في إمارة دبي. يتقاضى الوكيل من المشتري عمولة ومن البائع (أنا) رسوم تسويق تبلغ حوالي 40٪ من قيمة العمولة.

في حالة عدم اكتمال التعاقد بسبب خطأ من جانبي، فإن العقد المطلوب مني توقيعه ينص على:

أ) سداد الوديعة للبائع.

ب) سداد مبلغ إضافي يساوي قيمة الوديعة للبائع، و

ج) دفع عمولة الوسيط للوكيل.

هذا العقد بيني وبين المشتري والعقد المبرم بيني وبين الوسيط لا يتضمن دفع عمولة الوسيط، فهل النقطة "ج" أعلاه واجبة التنفيذ؟

In regard to the query and as per the answer, please note that since there is an agreement between you and the broker which you have signed, you have to pay the commission.

If the commission is not mentioned in the agreement then it shall be as per the market rate. As they are charging 40% which is not as per the market rate, you may complain to RERA.

We need to check if it is a RERA Contract or an Individual Contract that they are having.

If it is a RERA Contract in which the Sale and Purchase Agreement is a standard RERA Contract, then the Terms and Conditions are enforceable if it was signed by both parties.
