Dear Sir,

If an employee did not complete his contract (for two years) and served only for 10 months, is he eligible for leave salary and indemnity?

Dear Questioner,

Based on your request, I understand that you have already terminated your employment contract with your employer.

If this is the case, I need to know if you resigned or the company was the one who terminated your employment contract and to see the labour contract, in order to provide you with a correct answer.

However, as a general rule, the employer is required to pay your unpaid salary (if any), your pending vacation days and the notice period (in case that you were terminated by them).

You are not entitled to receive the End of Service Gratuity since you didn't complete at least one year of continuous service.

Please provide me with the details, so I can advise you accordingly.

Best regards,

Raluca Gatina.
