Renting the property of the buyer by developer without approval
After completing the full amount, I am currently suffering a lot with the developer company as they have rented my apartment without my approval just one month before my handover date.
Until now I am trying to get the rental income but day after day they are delaying and every time they provide excuses they have deducted lots of money for management FEE and service charges advance payments, even as I have mentioned that the rent was done without my approval.
Is there any way I can complain about such misconduct from the developer company?
Please advise about my issue with the developer. I have purchased a unit in a project in April 2017 from an exhibition done by the developer in Oman.
The developer sold me the apartment in Oman and they know that I am not a resident of the UAE and therefore do not have any bank account in the UAE and can never create a current account according to the UAE law without having a residence card.
The developer asked me to provide bank cheques from a local bank.

As per your query, it is certain that you have purchased your property through the developer and the property must be registered on your name.
Further, in regard to your query please note that there are 2 steps –
Primarily, it is unclear on what basis the developer has put the property on rent. Was the property under a bank mortgage?
If it was in a bank mortgage, then the developer action will be justified.
If the payment is complete and the developer has still put the property on rent then immediately, it can be cancelled and the developer’s action can be restricted. Such illegal activity is a breach of trust.
Secondly, if the above action of the developer is not as per the law, then we can provide legal notice to the tenant for immediate eviction.
We have to see what are the documents which you have signed and under what arrangement, the rent is taken by the developer.
