إنهاء عقد عقار تحت الإنشاء بسبب التأخير في التسليم
لقد اشتريت شقة تتكون من غرفة نوم واحدة عام 2015 مقابل 1,04 مليون درهم وكان تاريخ الانتهاء المقرر هو يونيو 2017. دفعت 40٪ من سعر العقار، وكان من المقرر دفع 60٪ (625,000 درهم) عند الانتهاء خلال عامين (2017).
تأخر المشروع كثيرًا، وعندما زرت الشقة نهاية شهر فبراير 2020 لم تكن جاهزة.
يدعي المطور العقاري في الوقت الحالي أنه استلم شهادة إتمام البناء من دائرة الأراضي والأملاك بدبي وبالتالي يريد الحصول على المبلغ المتبقي 625,000 درهم. إنهم يدعون أن العقار جاهز للتسليم، لكنه يحتاج إلى بعض الأعمال ليصبح صالحًا للسكن.
أنا مواطن بريطاني، وقد تغير وضعي المادي في السنوات الخمس التي تلت عملية الشراء. لقد احتفظت بنسبة 60٪ من قيمة العقار، ولكن منذ ذلك الحين، لم يعد وضعي المالي كما كان وليس لدي 625,000 درهم لسدادها.
لا يمكنني الحصول على المبلغ المتبقي كرهن عقاري لأنني مغترب. يمكنني الحصول على 50٪ من قيمة العقار كحد أقصى والذي تبلغ قيمته في الوقت الحالي 750,000 درهم على أقصى تقدير.

I would request the full documents and contracts to examine before being able to advise you about the subject, as we are talking about a real estate contract.
But in general, yes you can claim compensation for the delays from the court. Termination may be impossible according to the UAE Civil Law.
The UAE Civil law advises that if there is a delay on handover and the purchased unit is not ready, then the buyer has to get compensation but not terminate the contract as the seller has executed the contract with a breach that does not require termination. (this is the general rule unless the damage is higher and the purpose of the purchasing is no longer valid).
