Q: I live in a 4 bedroom apartment in Deira/Dubai.
3 out of the 4 bedrooms have sewage leakage problem somewhere in the ceiling and the smell is horrible. The landlord refuses to fix the problem even though my tenancy contract clearly states that he must fix on his expense.
To make the story short, After filing for a case against him at the RDC, It all went down to the police station where he refused to sign a paper that states his willingness to fix.
Next, a Dubai Municipality official visited the apartment and submitted a report to the Land Department confirming that the apartment smells very bad. All meanwhile I refused to pay any rent to pressure this landlord to fix.
So now 4 months have passed and the accumulated rent has built up to above AED 100,000. The landlord has filed a case to claim the rental amount.
What to do? And how can he file a case against me at the RDC without the RDC asking him to fix the apartment first?!
Can I refuse to pay this landlord? I think it is unfair to pay!

Liability for property maintenance costs at the end of lease

Q: Dear,
Last year, 28th September 2017 to be exact, we rented 1 BHK Flat in Bur Dubai. The flat is old and since we required it on an urgent basis, we took the flat with unfixed things.
We as the tenant fixed whatever is needed (bathroom door, kitchen cabinets, bathroom ceiling...etc.). We decided not to renew the contract due to the maintenance issues we had encountered.
Now, the real state agent is asking us to pay the maintenance which quoted me for AED3500/- (kitchen and toilet ceiling change, full flat ceiling change, light change, switch change, kitchen exhaust fan change, all cleaning, shower pipe change, cabinet hinges repair, all materials and labours).
Do we really need to pay for this maintenance?
Please advice.

Premature termination of tenancy contract due to defects of the property

Q: We have still 7 months left on our tenancy contract but the property has too many issues and in one room the ceiling has fallen down due to leaks.
Is there any way we can break the contract and receive the rent for remaining months and our security deposit back?

The developer failed to rectify the numerous leakages in the apartment, what to do?

Q: Good afternoon,
I have purchased a property in Al Barsha (top floor). In spite of repeated reminders, the developer failed to rectify the leakages (numerous) in my apartment.
I had also notified this during DLP (Defect liability period). Can I refer my dispute to Rental Disputes Committee in Dubai Courts, even though there is an arbitration clause in the Sale and Purchase Agreement?
Appreciate your guidance on this.

How to prove the bad smell and force the building maintenance to fix it

Q: Hello,
Just need to clarify this.
We are facing a serious (really horrible) drainage smell from the kitchen (sometimes we are unable to cook food due to the horrible smell) but unfortunately we can't give proof, pic... etc. on this case.
The stinking smell is not consistent or regular but somedays morning or other days at night. The building maintenance clearly knows the issue but they are not able to do anything and management is not taking any action.
The owner's office wont allow tenant's to contact the owner.
Kindly advise and help.

How can I move out of an apartment without liability if the owner is not doing maintenance?

Q: We have 6 months to mature the contract. From the starting date, the building owner is not doing any maintenance, and wastewater is coming inside the house.
I want to cancel the contract and move to some other building. I have a child, how can I handle the owner?

Fixing a persistent ceiling leak in an apartment with minimal hassle

Q: Dear Community,
I am seeking your support and guidance regarding an issue in my 2-bedroom apartment in Sharjah.
The hall of my apartment has been experiencing leakage from the center of the ceiling for the past 4 months. Despite my repeated complaints and requests to the real estate company, they have not repaired or solved the problem.
Can anybody advise me on how to resolve this issue with the least amount of hassle?

Bank filed a civil case over a loan: Better to settle with the bank or in court? 0
Good day, Sir,
I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019.
I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED.
What will be the best way for me to proceed: approaching the bank or dealing with it in court?

Demanding that an employee pay for visa charges a year after resigning 0
Dear Lawyers,
I worked at a bakeshop here in Dubai. I resigned exactly one year ago. Now they want me to pay for visa charges, as stated in the offer letter.
If I cannot pay for the charges, my employer will claim financial loss due to the damages, estimated to be at least 7,000 AED.
What should I do about this? My monthly salary is only 2,800 AED.
