العواقب المترتبة على إنهاء العقد من قبل العميل بعد استكمال بناء العقار

لقد دفعت 20٪ من قيمة عقار تجاري مكتمل البناء. لا يمكنني تدبير المبلغ المتبقي وأريد إنهاء العقد.

هل يحق للمطور العقاري قانونًا أن يطلب الحصول على 20٪ إضافية للتنازل عن إجمالي 40٪ من قيمة العقار قبل إنهاء العقد؟

هل يستطيع المطور العقاري رفع قضية جنائية في حالة عدم سداد القرض البنكي؟

Dear questioner,

Regarding your question, if the builder can put a criminal case for the non-payment of a bank loan? No, he can't because the loan belongs to civil and commercial law, but if you signed a check related to that loan without balance, it will be possible to prosecute you criminally.

Regarding breaching SPA, it depends on the conditions of the contract and the negotiation with the builder.
