If it is written in the SPA that there is a 1-year delay from the completion date, mentioned there, then you have to wait 1 year and if the property is not delivered, you can terminate the SPA through the court and claim money refund.

To give you a more advanced answer, we need to see your SPA.

My contact anticipated construction completion date to be quarter 4,2018.

The contract mentioned: without prejudice to the seller’s rights under clause 15 in respect of force majeure events, the anticipated construction completion date may be extended one year by the seller.

So the seller has the right to delay one year?

Dear Questioner,

Yes, Dubai has the law and regulation which give the legal right to the vendor to be delayed but he should send you a legal notice and give you the absolute legal right to cancel the contract in an appropriate way based on the law and a reasonable reason.
