Q: I have been working with a private company for 2 years and 10 months on an unlimited contract. Three months ago my employer cut Dh 3000 from our salaries and later asked us to sign a letter saying that we accept a deduction until the company's financial condition improves. There has been no change in the contract though.
My employer also increased our working hour by 30 minutes every day, for which we were sent an email.
My questions are:
1. If I leave the company, can I claim the salary which has been deducted back?
2. Will my final dues be calculated based on the salary mentioned in my contract or the reduced salary?
3. Can I ask for overtime for the increased hours? It is mentioned in my contract that overtime will not be paid.

Q: Hi,
I have an LLC company here in the UAE. Due to financial difficulties, I am not able to run it further. Hence I have decided to shut down the company.
I want to check how much notice do I need to give to the employees. All the employees are on limited contracts. Can I issue a 30 day-notice period letter to them for operations closure?
I will give the salary to them till the last day of their service and will also provide them with airfare to get back to their home countries after visa cancellation.
Also, I want to write in the notice period letter that if at all I find any suitable buyer for the company, the company shall continue under the new buyer's name. But if no suitable buyer is found till the notice period ending, I shall liquidate the company.
Kindly advise on the legal complications involved in this!

Forcing the employee to accept a reduced salary

Q: My previous employer is a private company and I worked with them for 1 year and a half on an unlimited contract.
My previous employer has forced on me a salary reduction which I didn't agree to and no letter was signed.
Due to not agreeing to this salary reduction, I was forced to transfer almost half of my combined salary from months of Feb 2018 to June 2018 or else lose my job.
Afraid to lose my job and under this threat I had to transfer almost half of my salary to the employer. I want to claim back all the salary that was wrongfully taken from me.
I have bank statement proof that showed the amount that was transferred from my account to the employer in July 2018, and starting July 2018 payroll I was getting the reduced salary.
I also have my previous labour contract that states my monthly salary.
1- What are my options?
2- Would I be able to claim all the deducted salary if I provide the court with the evidence?

Q: Dear Sir,
My Name is M. N. U. H. and I am working in the UAE since 2008. For over 12 years I have been a law-abiding citizen. In my last job since 2014, I worked hard and never had any complaint work-related.
Our company hasn't paid me any salary since January this year and I understand that it's difficult due to current circumstances, but I haven't been paid way before the pandemic.
My visa is expired since January and my car insurance and registration expired as well. All I want is to get my hard-earned money which is approved by the court but it is delayed I don't know why.
I have a family dependent on me and I am failing badly. I request you to please help me out. The verdict came 6th October but I don't know when I will get my money.
Is there anything I can do to speed up my case?

Terminating an employment unlimited contract due to salary deduction

Q: Respected Lawyers,
My employer is deducting AED 3000 from my salary every month while my contract is not changed for the deduction. I have the following questions regarding this point:
1. Can I claim these AED 3000 from my employer via a labor case?
2. If I file a case in the labor against my employer, can my employer terminate/cancel my contract during the case or does he have to wait until my case is resolved?
3. What is the maximum time limit for a case to be resolved?
My contract is unlimited.

Hello,
There was a bounced cheque case against me in Dubai in 2009-10. I won the case upon appeal in January 2020. I have been fighting extradition to Dubai since 2018 for the same case.
Even though, the case was won in January. Until today (December 2020), the authorities in my country of residence (Ukraine) haven't officially received the judgment from the UAE.
1.What steps can be taken to expedite this process?
2. What steps does a judgment go through before it is communicated to the country in which the extradition case is pending?
3. What is the normal time frame for this process and for the removal of the Interpol red notice against the accused?

The developer failed to rectify the numerous leakages in the apartment, what to do? 0

I have purchased a property in Al Barsha (top floor). In spite of repeated reminders, the developer failed to rectify the leakages (numerous) in my apartment.
I had also notified this during DLP (Defect liability period). Can I refer my dispute to Rental Disputes Committee in Dubai Courts, even though there is an arbitration clause in the Sale and Purchase Agreement?

Dear Sir,
I am working with Jafza company as a product development manager under a limited contract.
Today, I am giving my 30 day-notice period against my contract. My contract will end by July 2021. I heard that I need to pay 45 days' salary to the company because of contract breaching.
I would like to know:
1) If I am giving an advance 30-day notice period, then why should I pay 45 days' salary to the company?
2) Currently, am I not doing my job as per Jafza attested contract?
3) After a year, the company changed my job profile without any amendment in Jafza attested contract?
