Objecting to a cancellation letter from DLD and claiming refund
Hi,
I have booked a studio with a developer. I have paid around 195000 AED. It was mentioned in their marketing details and pre-development that the project will be ready by MAY 2019. The project is still not completed, and only 50% has been done as per DLD.
The developer has always been asking for money, but how can we trust them when progress has been slow!
Today, I received a letter from DLD on cancellation.
Now how can I proceed to object and get the paid amount?
I was reading somewhere that if a project is below 60% progress, we can get a refund?
Please guide!

We would like to inform you that yes, you still have an absolute legal right to return your payment back even if the project has been canceled.
First of all, we have to check your name if it is listed on the investor's list or not.
Second, we should be sure that the property has been registered under your name in the premium real estate record.
Third, you should have the relevant invoices from the developer which proves your payment.
Regarding the legal procedures, we can assist you to sue the developer before Dubai court and claim your money plus the benefits and relevant compensation. But before that, we have to check the SPA and the reservation agreement signed by you and the developer.
