Refund of money paid for realty in Ajman
I purchased an off-plan property in Ajman back in May 2007.
I was supposed to possess the property by the end of 2009. Till now, the tower has only two floors above the ground and it seems that the construction stopped at that level. I have paid almost 80% of the total value.
I tried several times to reach the Developers, but they are not responding to my emails and phone calls.
What can I do in this situation, and do I have any chances to take my money back?

The sector of real estate in Ajman is regulated by local legislation, including:
- Ajman Amiri Decree No. (12) of 2008 amending Amiri Decree No. (8) of 2008 regulating the Condominium of Real Estate Projects and Investment Buildings
- Ajman Amiri Decree No. (7) of 2008 A.D. Concerning the Acquisition and Registration of Land Ownership in Ajman and some others.
According to the rules and regulations, the developer has the obligation to complete every construction phase in accordance with the instalments made by the buyer.
According to the information provided by you, breach of contract by the developer applies in this case.
Generally, in such cases, there are three steps to follow:
- To contact the developer and negotiate the possible solution of the situation (possibly through mediation);
- To execute the pre-trial dispute resolution procedure (through sending a legal notice to the developer)
- To open a case against the developer at the court.
