هل يعد خفض الراتب قسرًا فصلاً تعسفيًا؟

أنا موظف في القطاع الخاص بموجب عقد عمل محدد المدة ساري بدايةً من 22/04/2019 وحتى 21/04/2021.

بمجرد توقيع هذا العقد، طلب مدير الشركة أن أوقع عقد عمل آخر يسري بدايةً من 01/05/2019 وحتى 31/12/2019 وأخبرني أن هذا العقد لمقر الشركة الواقع خارج دولة الإمارات.

كان هذا العقد مكتوبًا على ورق الشركة الرسمي فقط، وليس مقدمًا من وزارة الموارد البشرية والتوطين. لقد وقعت عليه واكتشفت لاحقًا أنه غير مُلزم قانونًا في دولة الإمارات.

في الوقت الحالي، يعرضون علي عقدًا مماثلاً مرة أخرى ساري بدايةً من 01/01/2020 وحتى 31/12/2020 براتب مخفض. على الرغم من أنني لا أريد قبول هذا الراتب.

إذا لم أوقع هذا العقد، سيتم إنهاء خدمتي. إذا قاموا بإنهاء خدمتي، هل سيدفعون لي تعويضًا قدره راتب ثلاثة أشهر أم لا؟

هل سيكون للعقد الذي وقعت عليه في شهر مايو بتاريخ 01/05/2019 أي تأثير على هذا التعويض؟

Dear questioner,

If the reasons for termination are not related to performance, then you can claim salary up to 3 months in lieu of arbitrary dismissal.

Greetings,

Please advise about the second contract, do you have a copy signed from the company as well?

Also for the termination of the limited contract, you can claim notice period for 3 months and termination compensation for 3 months as per Ministerial Decree issued by the Ministry of Labor Department 765 of 2015.

Kindly advise about your contract and advise which court is the court of jurisdiction.

I have both expired and new proposed copies as well. However, I will have to tell them my answer tomorrow.

The problem is we do not have even HR to discuss the question. Only GM and 2 assistant managers. They will decide depending on the situation. The case is not in court yet.

Then your best answer is to ask them to inquire about the information from the labour office.

Also, you have to know that if you signed a new contract, they may terminate you the next day and you lose lots of your benefits.

  You have already exceeded the probation period and better not to sign.
