Drug abuse and circulation in the Law of Narcotics and Psychotropic Substances

My son had been arrested by the police for smoking an illegal cigarette with his friend.

I want to know the rights of my son who's in detention since one week, where he was beaten when arrested, pressured to provide information about his source and threatened to be accused of circulating drugs and selling it.

I still can't believe that my son can do such stuff. I am aware that what he had done is not acceptable, but we are an educated family. My son is still pursuing his studies and he doesn't need money, not in this way of course.

I need your help please to know how to act and preserve his rights, without provoking the police so that they accuse him of something he didn't do. All I want is to get him out of jail on a bail, affidavit or anything else.

First: Pursuant to the article (7) of the Law of Narcotics and Psychotropic Substances, if he purchased a hash cigarette with the intention to smoke it and was arrested before he smoked it and without circulation, he will be punished with an imprisonment not less than three months and not more than two years, and a fine not less than one thousand dinars and not more than three thousand dinars.

Second: Pursuant to the article (14) of the Law of Narcotics and Psychotropic Substances, if he purchased a hash cigarette and he smoked it and without circulation, he will be punished with an imprisonment not less than one year and not more than two years, and a fine, not less than one thousand dinars and not more than three thousand dinars.

Third: Pursuant to the article (8) of the Law of Narcotics and Psychotropic Substances, if he purchased a hash cigarette and he smoked it and circulated it, he will be punished with life imprisonment with hard labour and not less fifteen years, and a fine not less than ten thousand dinars and not more than twenty thousand dinars.

Fourth: Pursuant to the article (114) of the Civil Law Procedure, the public prosecutor may extend his period of detention and you may seek to release your son with a bail decided by the public prosecutor or the court.

Fifth: Pursuant to the article (175) of the Criminal Law Procedure, your son shall present his defence to prove his innocence or grant a Power of Attorney to a lawyer to do the same.
