Dear Sir,

I am asking about the civil case, not the criminal case.

My question is till when can we open a civil case (criminal case is over and judgment was fine and it was paid to the court)?

Now, until when the civil case could be filed to recover the amount?

I hope you understand, please reply so we can go further.

Hello.

The actions of recourse initiated by the cheque bearer against the drawer, endorsers and other obligors for the payment of its value, will not be heard after a period of two years from the expiry of the time-limit set for presentment thereof.

In case a lawsuit is initiated, this time limit shall only apply from the day of the last action taken thereon.

In addition, such time limitation shall not run if the debt is adjudicated or when it is acknowledged by a separate deed resulting in the renewal of the debt.

It means we cannot open a civil case after two years, is it right?

29 Dec 2019, 08:52

Two years from the day of the last action taken in this case.
