Q: I am working as a trainee for an LLC company in Dubai since May 13, 2018, but I received my appointment letter as sales coordinator on June 2, 2018.
I got my company visa only in Aug 2018. Until August, I was working on my visit visa, since the company asked me to do so. Now, I am under 6 months probation period.
My job designation on the visa is Sales Executive even though I was appointed as Sales Coordinator. I want to quit my job desperately since I am unable to handle the work pressure.
I am handling the sales coordinator as well as executive job and office jobs at the same time, but I still didn't finish my probation period. My employment contract is unlimited.
So will I get a ban or am I supposed to pay visa expenses to the company if I resign before the completion of my probation period?
Will I have to serve notice period if I resign? Also, what will happen if I am terminated?
Please answer.

Application of the labour ban for resigning during probation

Q: Dear Sir,
Good day!
I am working in an LLC company under a telecom company and I am under probation for 3 months. I started newly, 1 month now in my probation and I have an unlimited contract.
But in my contract, I have only a 1-year contract period, I just want to know if I resign early due to my personal matters where my brother got jailed now in police authority.
Does my company have the right to impose on me a ban and recover all the expenses they had processed on my visa?

Q: Hi!
I am working in an LLC Company. It has been 3 months only and I am still in the probation period.
I have resigned but they are asking me to pay visa charges from the final settlement. Is this legal?
If not, how can I complain and where?
it seems that my visa is a Free Zone.

Q: Hi,
I have been working in the UAE for 8 years and 4 months at the same company.
I have just renewed my new visa last August. Now, I want to resign because of so many issues. The main issue is not paying salary on time.
If I calculate my pending salary, it will be more than 3 months.
In this situation, if I resign, do they have the right to deduct my new visa dues?

I have been working for 1 year and 6 months in a restaurant without a vacation. Due to my health, I had resigned, and when receiving my payment, they had deducted 4200 for the visa.
Please I want to know if it is allowed to pay for the visa.

Rights of the employee in case of resigning during the probation period

Q: I was working in a company in Dubai on a family visa. I was not provided with any labour contract during my tenure. I have resigned under probation serving 7 days of notice period as per their contract.
They also deducted my 1 month & 8 days of salary by considering it as training and licensing cost. Now the HR and the manager are not responding to me to clear my incentives and complete my exit process.
I also want to know whether the employee is supposed to bear the cost of licensing (DHA) if he/she resigns under the probation period.

كما هو معلوم فإن قانون العمل الجديد رقم 33 جعل جميع عقود العمل محددة المدة، ولدينا الأسئلة التالية:
1. مَن يتحمل تكاليف الإقامة في حالة استقالة العامل قبل انتهاء عقد العمل؟
2. إذا كان قانون العمل يتيح لصاحب العمل تحميل العامل تكاليف الإقامة في حال استقال قبل انتهاء عقد العمل، فهل يمكن لصاحب العمل وضع شرط جزائي في عقد العمل ينص على تحميل العامل تكاليف الإقامة عند الاستقالة قبل تاريخ انتهاء العقد؟ وما الحد الأعلى للشرط الجزائي؟

The landlord has not returned my security deposit worth AED 5000. I filed a case and have judicial announcements that the landlord should return deposit+expenses. But still no response.
The landlord is out of the UAE and his property is handled by the agent. Not sure how to get my money back while I followed all procedures, even filed an execution case but no response.
While I keep paying to follow up on the case, the property is rented out to the next tenant and earning money. I feel like this system is created like this on purpose.

Is it possible for the employer to drop a case filed by employee in free zone? 0
I filed a complaint to SHAMS regarding unpaid salaries.
My employer drafted a contract saying I should drop the complaint within a week. If I fail to do so, they have the right to do it themselves.

Winding down an LLC company and the liability of the manager after absconding 0
Hi there Michael,
I am a 24% shareholder in an LLC wherein the other shareholders are our local partner with 51% shares and the partner who is listed as manager on the trade license with 25% shares.
The manager has absconded leaving behind unpaid VAT and other debts that are well over 30 days due (up to a year). No proceedings by creditors have been filed against the company and the MOA contains a general POA in favor of the Manager.
I would like to wind down the company without going through bankruptcy procedures. My understanding is that the listed manager of an LLC is personally liable for the Company's debts.
I need advice about the procedures required to wind down the company. I do not wish to go through bankruptcy procedures as the finances and management of the company were being handled by the manager. I am just the creative director of the LLC.
Please advise as soon as possible.
