Lately, we are exploring the South African market and we would like to hire a local person in South Africa. However, We don’t have a legal entity in South Africa. We are exploring an option where an employee can be governed by Dubai payroll but he/ she will be delegated to South Africa (Employee will get benefited in this case as he/ she gets ESOPS/ RSUS as we have a legal entity here in Dubai). I have following questions: Is it a smooth option to explore? (If we want to make a South African national as Dubai entity employee but delegated to South Africa). What's the detailed process to put him/ her on the payroll (Visa, registration...etc.). I highly appreciate your inputs in this regard.

Q: I am on a renewed limited contract and I submitted a resignation with 2 months notice period. Now, I can not render my 2 months notice period because the new company that I found can not wait for 2 months. Q: Hello, I am working in a security company based in Abu Dhabi as a Security Guard since Jan 17, 2020. I have spent the last 3 months here but the company has just paid us a few expenses and the job has not started yet. I paid around 16k AED for this visa. I have a 3 years visa (with limited employment contract) and Emirates ID. I don't have any labor card. 1. Is it a free zone company? how do I know? 2. I want to resign with notice period, is there any ban on me when quitting this job, or would I change my visa to any other free zone or any state of the UAE? Q: Hi, I was employed in a free zone in Dubai but worked in Saudi Arabia on a business visa. Can I ask for any compensation for it if there is nothing related to this in contract? Also, I resigned and served the notice period in Saudi Arabia only and then the company sent me back to the UAE for visa cancellation process as I need to take the final exit. In this case, am I eligible to get the salary until my visa get cancelled or just the for the notice period? Because after the notice period is over I did not work and being an expatriate I have over expenses because of this delay. Thanks

Q: Dear all, I was hired as GM for a company in Dubaï which is a subsidiary of a European Holding. For 3 months, I did not receive my salary. The local company (LLC) is about to close with no more assets & no local funds. We used to receive funds from this holding to pay all local expenses. My company doesn't want to terminate my contract even they invoke that I am not working. Indeed, they removed from me the business car, the professional phone number, and the professional email without notice. The local sponsor and the director of the holding are the only ones mentioned as managers & shareholders on the trade license. Any chance to get my salaries + gratuities? Should I send a letter of resignation then and cancel my visa if the local sponsor accepts? What are the legal consequences for both sides? According to my employment contract, I should have 3 months' notice period for termination. In case of an "act of negligence", they can terminate my contract immediately (no notice period). The Decision establishes a new employment system in the UAE allowing employers to recruit employees classified as skilled workers level 1 and 2 for a part-time job. Under this decision, skilled employees who are already employed elsewhere, can work with more than one employer under a part-time contract without the permission of any employer.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.
