Delaying the settlement while the unlimited contract is already terminated
I have been working for a company for 9 years and 6 months, but I was terminated last September 19, 2019. I served a 1-month notice. My contract is an unlimited contract. I informed our HR that I'm going home for good and not looking for any job.
But until now I didn't receive my settlement (Dh109k as per the account). They keep me waiting here, and I don't have money left to use and pay my rent.
My visa expires in March. Is this legal?
What action do I need to do? I want to go out to the UAE to start a small business in my country.
Please advise me on what to do. I am now more than 3 months without work here in the UAE.
Thank you for any advice!

Dear Sir,
You did not mention whether your visa was cancelled. Did you sign any papers for cancellation of the visa?
If Yes, you have overstayed in the UAE and may be subject to fines. In any case, please proceed to file a case with the Ministry of Labour (MOL).
You first need to file a complaint with the respective regulator depending upon whether your company is in the free zone or in the mainland.
If it is in the free zone, please find out who the regulator is and call them to enquire the location.
If your company is on the mainland, then you need to approach the Tawfouq Centre in Ras Al Khor to register your complaint.
Once the complaint is registered, the employer will be compelled to meet with you and the regulator to resolve your matter.
Please proceed with this action ASAP as you have wasted a lot of time. You can inform the regulator/MOL that while your services were terminated, the employer has not cancelled your visa.
You may call me for free legal advice and guidance.
