Labor case judgement execution

Q: A labour case was ruled in my favour and I received the judgement at the end of 2016. The judgement progressed to execution and not One Dirham has been paid by my ex-employer to date. We have spent the last year searching assets in all banks, combined with real estate, RTA etc. and all have come back with no assets. An attachment was made on the office assets, shortly after the Rental Dispute Committee issued a Judgement awarding the office assets to the Landlord. Finally, we located a valid Bank Guarantee held with a Government Authority. But the entity is not cooperating. As per Federal Law No. 8 for 1980 On Regulation of Labour Relations, Article 4 gives priority over all assets. However, in this scenario, Federal Labour Law, Dubai Real Estate Laws and further laws are all overlapping and conflicting. My query is, is there a document or law that states which law has priority over another to help resolve the issues I am facing with the judgement execution?

Precautions during court proceedings to guarantee your rights at execution

Q: I am seeking compensation for damages from a company that used my name in fraud. I have finished the case until the appeal court and the execution court has ordered that the company assets and accounts be attached until they pay the sum required as per the judgement. The company has been closed since last year and has no more money left in the bank. If there are no more assets of the company I could go after since the company no longer exists, how else can I get justice aside from the words written on a few sheets of my case judgement paper? I've spent a lot and exerted a lot of effort seeking justice for myself, and when it is time to collect what the judge has determined what I should have, apparently there is nothing left. Is there any other legal recourse? Thanks

Execution of a labor court judgment while the company no longer exists

Q: A labor court judgment was ruled in my favor (I'm an employee) in December 2019, against my ex-employer, for nonpayment of salaries, expense claims, and gratuity. Unfortunately, they still haven't settled my dues. Worse, the owners left the country and the company no longer exists in its physical form; there is only a legal structure. They do not have any assets either. Does it make sense to still seek judgment execution? Also, are there any provisions to pursue the execution order in their present country of residence?

Q: Hi sir, I am working in a Dubai based company. I filed a labor case against my company. I got a judgment in my favor. After that, I filed an execution. Now, I got some emails that the court has sent letters to various departments to execute the amount. Now my question is: If there is no amount or property available under my employer's name, what will be the next procedure? As I know, there is no property in my employer's name, and my employer is not in the country for the past 2 years. The company is also closed. One more thing, some payments have to come from Dubai Municipality to my company due to incompletion of a project. They did not release the payment during that time. Is there any possibility for the court to request DM to release payment against my case? Please advise!

Q: I have received a judgement in my favor in a case against my previous employer (LLC). Now it is in the execution stage. The particular division of the company where I have worked is not active. There are no assets or funds. They have made a person the manager and shifted him to India so arresting the manager is also not possible. The owner of the company has other active companies. They are not at all willing to pay anything. Most of my colleagues are also waiting in the execution stage. It has been more than 3 years now. How to claim labor dues from the employer after filing execution case?

Q: I was employed by a company that couldn't pay its employees but kept promising us to hang on. The funding was coming. Many months of promising and the money never came. I eventually left after working for them for 8 months. I opened a court case and eventually won the court case working through the Al Adheed Center (it's a lengthy process). But still, the company has not paid. They were notified by a newspaper because the office is now closed down. I have no idea where the owner is. I have copies of his passport (he actually has 3 that I'm aware of) and his emirates ID. I asked the courts to issue a travel ban against him, but they won't do it because the company trade license is now expired. I can't believe I've spent about AED 15,000 on court costs, only to be told now that basically, he is going to get away with it. What are my options? What can I do? 35 employees worked and did not get paid. Some opened court cases, some chose not to.
