Prevailing salary in case of contradiction between offer and contract
Hi Ahmad,
I am presently employed with a company based in DMCC JLT for almost 3 years now.
My query is that what should I consider with regards to my salary, DMCC contract or offer letter?
I noticed that the salary in my contract is higher than what is written in the offer letter which I'm presently receiving.
Also, in case the contract should be the one to consider, is there a chance that I can get those underpayments from the 1st month of my employment?
Hoping for your most favourable reply.
Respectfully yours,
T.
Dear Questioner,
Your actual salary received to your bank account is the real salary that you should consider even if it contradicts what is mentioned in any of the contracts.
In case of any contradiction, your actual salary will be the one you receive not the one in the contract unless it is mentioned in the contract that you should get a higher salary and you only receive 80% or less of it for example.
Then, you will have the right to claim the difference.
Let me know if you would require our help to formally claim the difference or to manage any possible conflict between you and your employer.
