Q: Hi,
I have submitted my passport in Sharjah Courts in order to bail my partner (cheque return case), almost 6 months gone. I need to take out my passport to renew my visa.

My name is Syed Majid, I want to know some details about one case.
I have kept my passport as a guarantor for one person in a bounced cheque case, this person has got 2 months jail but he has already left the country for more than 1 year. He was in contact for few days but now he is not in contact.
Now, my passport is in Dubai Courts and my visa is getting expired next month. I am stuck here and I want to go back my country. I am an educated person and have given my passport with a good intention to help.
Can you please help or suggest me to get my passport back?

Criminal case on a bounced cheque for pending loan

Q: Over AED 200k or under AED 200k?
I am confused as to how my police case will be treated by the police/justice system based on the 200k rule. The bounced cheque was for AED 235,000.
However, my outstanding balance with the bank is around AED150,000. The cheque is slightly above 200k yet the outstanding balance is below 200k.
Is it safe to assume I'm being treated as though the cheque was under 200k? How do I find out sure?
I only received a paper with my photo on it which the policeman asked me to sign. I have no idea what I signed as it is all in Arabic.
Secondly, why did the airport police take my passport? I thought the police no longer confiscate passports for loan cases due to the new 'smart bail 'system.
My visa is up for renewal in 1 month. Can I get my passport back from the police (even just temporarily) to renew my visa?
If I can't renew my visa, I can't work and won't be able to pay anything. As long as I renew visa and keep my job, I can settle the loan in around 6 months.

The UAE Penal Code, like all other laws, addresses the crime of fraud in Article 399 of the UAE Federal Penal Code, which stipulates that whoever seizes, for himself or another, a movable property, or obtains a document or signature thereon, cancellation or destruction thereof or amendment thereto by fraudulent means, or by assuming a false name or capacity, where such an act leads to deception of a victim and leads him to surrender shall be punished by imprisonment or fine.

Termination for non-performance without prior warnings 0
Hi!
I would like to ask for advice.
The company has terminated me last June 30, 2019. My work is a visual merchandiser and we have 16 stores across the UAE which I need to visit all in one month.
But last April and May, I have not visited some of the shops due to other important and urgent work.
The company suddenly send me a termination letter due to non-performance which I am really shocked because I didn't understand that they put non-performance if I am doing other important and urgent projects.
There is no warning letter given to me. Since I'm getting pressure from the HR, I had signed the termination letter and it was effective June 30, 2019.
But after 3 or 4 days, the company asked me to come to work for 1 month notice period July 1-31. Then they ask me to work again in August, and then until September 15. Then they terminated me.
I need your advice if there's a chance that I could complain about this to the labour and the chances of getting the correct compensation.

Hello,
Can I please request an expert view on the below issue and possible further guidance?
I would like to know if employees have filed labor complaints due to outstanding salaries, then:
1. If the employer does not give immediate cash settlement or agrees to provide personal PDCs to cover outstanding salaries&gratuities in a complaint of the labor dept., then how long process may last if it is escalated to labor court? And are the employees to continue work or stop?
2. Can employees switch visas if the issue is in labor court?
3. Can the company which is an LLC still proceed to apply for liquidation?
4. If they can, then how can salaries&gratuities be protected for the employees?
5. Should employees engage a lawyer to represent them against the owners of the company who decide to go into liquidation?
