Q: Hi!
I would like to ask for advice.
The company has terminated me last June 30, 2019. My work is a visual merchandiser and we have 16 stores across the UAE which I need to visit all in one month.
But last April and May, I have not visited some of the shops due to other important and urgent work.
The company suddenly send me a termination letter due to non-performance which I am really shocked because I didn't understand that they put non-performance if I am doing other important and urgent projects.
There is no warning letter given to me. Since I'm getting pressure from the HR, I had signed the termination letter and it was effective June 30, 2019.
But after 3 or 4 days, the company asked me to come to work for 1 month notice period July 1-31. Then they ask me to work again in August, and then until September 15. Then they terminated me.
I need your advice if there's a chance that I could complain about this to the labour and the chances of getting the correct compensation.

I will file arbitrary dismissal because they terminated me for no reason.

I am the GM of a company in the Internet City and the VP Sales MEAA.
My contract has been terminated after 13 years due to some results that did not meet the company expectations.
No process was followed prior to termination. I wish to know if I will have a claim for arbitrary dismissal.

Termination of an employee after filing a labor complaint for non-payment of dues

Q: 2 months back I filed a complaint to the labor because I wasn't getting off days.
My employer decided to give me two off days per month, but after two months he came back saying he is going to terminate me because all workers are complaining, and he going to compensate me.
Among the money calculated was all the overtime money, gratuity, pending salaries, dismissal amount (3 months' salary).
So we agreed on the amount to be paid, but when they presented the end of service entitlement form, the agreed amount wasn't stated and I refused to sign it. I went to the labor office and filed my complaint.
Now because I filed the complaint, the company has immediately stopped me from work. Is it right for them to stop me?
And was the amount I calculated the right one?

I was terminated. Will I get termination pay along with gratuity?

Q: Dear Sir/Mada,
I work in a Free Zone as a Service Manager of a Facility Management company. I began working on December 1, 2008.
On November 6, 2023, I received a termination letter from management citing restructuring, and they provided me with a one-month notice.
As this is a termination, will I receive a termination payment in addition to gratuity?

The landlord has not returned my security deposit worth AED 5000. I filed a case and have judicial announcements that the landlord should return deposit+expenses. But still no response.
The landlord is out of the UAE and his property is handled by the agent. Not sure how to get my money back while I followed all procedures, even filed an execution case but no response.
While I keep paying to follow up on the case, the property is rented out to the next tenant and earning money. I feel like this system is created like this on purpose.

Is it possible for the employer to drop a case filed by employee in free zone? 0
I filed a complaint to SHAMS regarding unpaid salaries.
My employer drafted a contract saying I should drop the complaint within a week. If I fail to do so, they have the right to do it themselves.

Winding down an LLC company and the liability of the manager after absconding 0
Hi there Michael,
I am a 24% shareholder in an LLC wherein the other shareholders are our local partner with 51% shares and the partner who is listed as manager on the trade license with 25% shares.
The manager has absconded leaving behind unpaid VAT and other debts that are well over 30 days due (up to a year). No proceedings by creditors have been filed against the company and the MOA contains a general POA in favor of the Manager.
I would like to wind down the company without going through bankruptcy procedures. My understanding is that the listed manager of an LLC is personally liable for the Company's debts.
I need advice about the procedures required to wind down the company. I do not wish to go through bankruptcy procedures as the finances and management of the company were being handled by the manager. I am just the creative director of the LLC.
Please advise as soon as possible.
