الاستقالة أثناء فترة الاختبار بسبب تصرفات صاحب العمل غير المهنية

مرحبًا،

لقد انتقلت حديثًا إلى إمارة دبي وحصلت مؤخرًا على وظيفة. لقد بدأت العمل في 15 سبتمبر 2019.

الشركة نفسها رائعة ولكن المشرف المباشر كان صعب المراس. يحب تصيد الأخطاء، الأمر الذي قاله بنفسه.

يجعلك تشعر بعدم الجدارة لدرجة تحطيم معنوياتك. أعتقد أنني سأبكي مجددًا.

 أريد أن أترك العمل، لكنني خائف من أن يفرضوا حظرًا على جواز سفري ويجبروني علي دفع الغرامات. تأشيرتي قيد الاستخراج في الوقت الحالي. لقد استخرجت بطاقتي الطبية في 6 سبتمبر الماضي.

ماذا يجب علي أن أفعل؟

Thank you for reaching out to me on this.

Considering you are on the probation period, if you resign from your job, there is a possibility you may get a labour ban of 6-12 months.

In the labour ban, you may not be able to work in the mainland but you can work in a free zone.

If you are holding a certain job position or educational certificate, then the labour ban does not apply to you. You should contact the Ministry of Labour to check if you fit within these criteria.

Assuming you are working in a free zone, then there is no concept of labour ban.

Further, the company may have a right to claim 45 days of basic salary from you, however, they need to prove the loss caused to them due to your resignation.

Considering you are being harassed by your boss, you may be able to escape the penalty as stated above.

However, I would urge that you contact the Ministry of Labour on 80060 to discuss this issue.

Since your visa is not stamped yet, you are in a better position to quit the company.

Dear Atty. Hari,

Thank you for writing back. This is very informative.

I called 80060 but the options were confusing for me. I have actually tried pressing all the options, however, I couldn't get to an actual operator whom I can speak with.

I believe I am on an unlimited contract. My colleagues say there should not be a ban because of the type of contract we have.

But I want to be careful. What do you think?

Also, I read online, I can't remember where, that in the event that you found a job with a better offer, you may leave your current job even while under probation.

It says you just need to present the offer letter from the new job to your current job. Is that correct?

I'm sorry for having lots of questions. I appreciate your time very much.
