Cancellation of visa due to the premature death of sponsor

Hi Sir,

My sister's family had to exit the UAE on 25th Sep as her husband passed away on 20th Sep.

Also given he was the main sponsor (investor visa) the resident visa of all family members had to be cancelled for them to exit and carry the human remains.

However, the family members now need to go back to the UAE for winding up their home & also children's school.

Can they enter considering the grace period of 30 days or do they need to re-apply for a new visa to enter the UAE?

Dear Sir,

My sincere prayers are with your sister's family in this difficult time.

I understand that the dependants have cancelled their visa and left for home country to carry out the post death rituals.

Since the dependants have exited the country, the question of 30 day grace period doesn't arise and they need to apply for a new residence or visit visa to return back to the UAE.

Assuming the dependants have not left the UAE, then a 30 day grace period will be applicable for them.

Kindly note that the dependants, including your sister, will have to apply for Inheritance Certificate from Dubai Courts for distributing the deceased assets in the UAE. Assets would include bank accounts as well.

I trust you will find this helpful.

Regards,

Hari Wadhwana

Hello Sir,

I have another clarification.

My Sister will be going to the UAE on a visit visa to clear & take her belongings via cargo back to India.

Would you know if there could be any complications with the customs given her resident visa is cancelled?

She has a lot of her household belongings from furniture, sofa, refrigerator, washing machine, television and others.

All items are used but we would not have any bills for the same as they are old items.

As long as they are being sent by cargo and disclosure is made, there should not be any complications.

However, if the customs levy any tax (which I doubt they will), that will be a different story.

Thank you, Sir!

Also, would you know if the original death certificates of the deceased person's parents are needed to process the inheritance certificate?

Will they be required or would photocopies be sufficient?

You will need the Original Death Certificate attested by the authorities to process for the inheritance certificate. To know more about attestation please contact Attestation agents.
