Q: Dear Sir/Madam, We are a company registered in a free zone with a bank account in Abu Dhabi. We have a friend in Germany who is floating his own startup. He is seeking a loan. Are we allowed to provide this loan from the excess funds of the company, accompanied by a properly drawn-out agreement with a definite return date?

Q: So my friend asked me to give him a loan of AED 17,000 and he said he would give me interest. I was not aware at the time that interest is not allowed on private loans between individuals. For 5 years he said he would pay me back but he hasn't till now. I only asked him to simply repay me the principal amount and that I don't need any interest at this point. He kept stalling and finally, I was fed up with it and informed him Ill be filing a case. Now he is angry and he threatened me by saying that he will sue me back since interest on personal loans is not allowed. It's like he knew about all this from the start and he coerced me into this. I think his plan all along was to take the loan from me, offer me interest knowing it's not allowed, and then use that excuse not to repay it. The management of individual financial affairs is crucial and all the actions must be weighed down while committing to any financial liability. Whether it's job loss that may have lead to financial failure or the opposite, one must be aware of the personal liability which will not diminish by paying fines for cheque bounce cases. There are two major types of liabilities, criminal liability and civil liability. Each has its own significance, hence, must be dealt with accordingly.

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.

The provisions of this Law apply to the commercial companies established in the UAE and the foreign companies that have established in the UAE a base to conduct any activity therein or established a branch or representative office. The Law abrogates Federal Law No. (8) of 1984 Concerning Commercial Companies.

This Law applies to merchants, as well as to all acts of commerce carried out in the UAE by any person even though he be not a trader. Commercial matters regarding which specific Federal laws are issued shall be subject to the provisions of such laws, and to the provisions hereof which do not contradict with said laws.

The law defines the crimes related to money laundering, commitments and the jurisdictions of the governmental authorities, and the sanctions against perpetrators of money laundering.
