Filing a case to recover outstanding debts from a company
A company owes me 3 million dirhams.
Due to payment difficulties, I offered them a discount of 1 million dirhams provided they keep up to an agreed payment plan which was sent to them and which I have a copy of.
Now, it has been over a year since they haven’t honoured the payment plan. Can I file a case against them claiming the current outstanding plus the discount that I gave them?

Thank you for reaching out to me on this.
I am assuming you have agreements in place with respect to principal liability of AED Three Million and the settlement agreement wherein you had offered AED Two Million.
Considering the settlement offer was not honoured, the same is lapsed as per law and now you will be entitled to claim the full amount from the other party.
You can file a civil case based on the agreement and misc documents in the Emirate where the other party has his principal place of business.
You will be eligible to claim the full amount with 9-12% of legal interest and nominal lawyers fee.
The court fee for such a claim will be 6% of the claim amount with AED 40,000/- being the maximum court fee. Your documents will have to be translated into Arabic for the convenience of the court.
