Q: Hi, My company terminated my contract on 5-01-2021 with a termination letter effective the same day. I was forced to sign that letter and leave the premises. Therefore, they were breaching the contract as the contract stipulates that 30 days notice should be given. I started working for them in 07-11-2019, due to coronavirus I accepted unpaid leave for 15 days in May, 15 days in October and a whole month in December 2020. I filed a complaint and they sent me emails telling me to accept AED 10,637.07 as a total of what they owe me. Today, they want to add AED 7000 to this total but the issue is that it is not even close to what they really owe me. End of service, annual leave (0 paid leave so I should receive the full amount), notice period salary (full amount), air ticket and compensation (1 to 3 months negotiable as per the UAE law). I would like to know what should be done if they still don't comply with the UAE law. Thank you in advance

Q: Dear Ma'am, Greetings! I have a case where we have terminated an employee at 360 days, on an immediate basis. We have not allowed him to serve a 30 day notice period, however, we have compensated the 30 days through an additional salary. Please advise if we need to compensate the employee inclusive of the 30 days (notice period) in his leave salary and gratuity? Or do we take the termination date as the basis of calculation for leave salary and gratuity? Kindly advise.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
