Claiming title deeds from the developer after fulfilling all obligations

I bought two flats off-plan which were handed over in 2018. As a part of the handover, in December 2018 I paid for two title deeds.

To date, the developer has not delivered these, refuses to acknowledge my emails and does not answer the phone. What can I do?

Dear Questioner,

I suggest you hire a lawyer to serve the developer with a legal notice.

In case the developer did not comply with the request based on the documents you have, you can open a case against them.

In case you wish to proceed with the legal notice, please send me the following documents at my email:

- all contracts that you have signed with the developer

- all documents/contracts issued for the 2 flats

- all emails/messages communication between you and developer.

Thanks for your answer, it's appreciated.

The one dilemma that I have is that whilst I do want to hold the developer responsible, wouldn't it be cheaper to just apply for a replacement title deed when compared to legal fees?

Dear Questioner,

In case that you are 100% sure that the developer did the necessary steps in the land department  in order to receive the title deeds, and the title deeds are already issued and handed over to the developer (which does not happen if you did not provide the developer with a power of attorney), you can declare the title deeds as lost, make the report in the police stations, and request new title deeds.
