Q: Hi,
I am on engineer visa with a 2-year limited term contract from 24-Dec-2017 up to 23-Dec-2019 with my company. The last 2-Jun-2019, my company sent me a 1-month termination notice due to redundancy.
Now, I received my settlement computation showing my final salary, gratuity and leave entitlement only. They want me to sign my cancellation of the work permit stating that I received this settlement.
My doubt is, am I not entitled to the 3-month compensation due to early contract termination?
Does this termination due to redundancy exempt my company from paying me this settlement?
I hope you could help me confirm this issue.

Q: Hello Dr Al Bastaki,
I was made redundant last week. The employer stated it was NOT due to any performance issues but due to the reason of no projects coming up in future, so the need to cut the costs of the business.
I believe it is an arbitrary redundancy because it is not a performance related issue. Am I correct in thinking this way? What are my entitlements, if any, for compensation?
I have an unlimited contract.

Q: Hi,
I will be grateful to you if you could advise me on the following:
I have been working for an international company for about 12 years. Due to a recent restructure, I was made redundant.
My questions are:
1. Will this redundancy be considered an arbitrary dismissal? If so, will I be compensated based on my full salary, or the basic?
2. I have not taken my annual leaves for many years. Can I be compensated for the days I did not take in the past 12 years?

Q: Hi Sir,
Please, can you help me understand the following below?
I have been terminated from my company in Sharjah. I worked for them for 1 year and 7 months.
They had made me sign one letter on their official letterhead that they have terminated me and will be giving a grace period of one month.
This was a week ago. After this, now they have made me sign the cancellation letter for closing the contract.
What benefits will I get? Am I entitled to gratuity and termination fee?
Please, can you help me understand the Law of termination in Dubai, so that if in any part they wrong I could take legal action if required?

س: السلام عليكم،
لي أخ يعمل طبيبًا وكان يعمل بمركز طبي واستقال وانتقل لمكان آخر ولكنه لم يأخذ أوراقه؛ أي شهاداته ويمكن القول أن كلها صور ولكن بينها "شهادة تدريب مهمة" وما أخذه من الأوراق شهادة خبرة.
رفضت جهة العمل السابقة تسليمه شهادة التدريب وراسلها لمرات عبر البريد الإلكتروني طالبًا الشهادة ولم يُستجاب لطلبه.
أوصى بعض زملائه للتوسط للحصول على الشهادة وأيضًا تم الرفض، فما العمل؟
قد تسألون لمَ ترفض جهة العمل إعطاءه شهادته، والسبب أنه عندما التحق أخي بالعمل تم الاتفاق على إعطاء نسبة من الدخل، ورأت جهة العمل المبلغ الذي سيحصل عليه أخي كبيرًا فبدأت تماطل واضطر أخي للاستقالة وأُعطي تقريبًا ثلث ما يستحقه من النسبة والتي تبقت في ذمة جهة العمل.
أخي لا يرغب أبدًا في الذهاب للمحاكم ولا يفكر في هذا الأسلوب، فبمَ تنصحون للحصول على الشهادة؟
وهل يطالب ببقية مستحقاته؟
علمًا بأنه وقّع وتم إلغاء ترخيصه من الجهة المشكو بحقها.

I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019.
I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED.
What will be the best way for me to proceed: approaching the bank or dealing with it in court?

Dear Lawyers,
I worked at a bakeshop here in Dubai. I resigned exactly one year ago. Now they want me to pay for visa charges, as stated in the offer letter.
If I cannot pay for the charges, my employer will claim financial loss due to the damages, estimated to be at least 7,000 AED.
What should I do about this? My monthly salary is only 2,800 AED.
