Removing a travel ban requested by the guardian of a child

My question is about my son who has a travel ban for the past four years.

I am a divorced woman and the travel ban is from his father. I want to move back to my home country as I don't have any emotional or physical support here.

My parents are old and would like to move back for good. I have tried discussing this matter with his father but unfortunately, the matter is still unresolved.

I am willing to let go of all financial support in order to go back. Please let me know if this can be resolved in any way.

Dear Questioner,

The guardian has the right to put a travel ban on the child, and you need written approval from him to be able to travel.

Since the matter cannot be resolved amicably, you have to file a case at the court to request the removal of the ban.

The judge will only decide on the removal if strong evidence will be submitted to the court.

Good luck.

Thank you for your quick response, Michael.

May I ask what kind of evidence or situation would be considered strong evidence?

Would I have to do it through a lawyer or the request can be submitted directly at the court through e-petition?

I feel sad to know about your situation.

There are legal remedies to resort for lifting the travel ban for your child.

The application of the remedy completely depends upon the cumulative facts of your situation (case).

As a law firm, we would be able to assist you after evaluating the case in detail. Feel free to reach us.
