Q: Hi.
I am here in the UAE on a visit visa. A company gave me an offer letter, but it's already 2 months since I'm working here and still, they did not process my employment visa.
Now, my visit visa is going to expire soon. If they do not make my visa, can I file a case on the basis of offer letter? Where can I go for justice, and what do I have to do?
Please advise me.

I am working in one interior company in Sharjah. Nearly 2 months completed, but till now they didn't pay my salary.
I asked my company manager, owner and my agent, but no response. My agent told me tomorrow at 4 to have an appointment, then I tell you.
I have a tourist visa only, so give me a suggestion.

Employment fraud and working just for a visit visa period

This is Muhammad Usama Ali with you.
Actually, I'm from Pakistan and I was interested in working in Dubai. Meanwhile, my contact was with a person who used to say that I am the owner of the company in Dubai.
At that time, that person needed staff for his company and I also wanted a good job. Meanwhile, he talked about my job and told me that he will get some money from me for the visa.
So I asked him how much money I have to pay for the visa. He told me all the money. And then I asked him about the post and he said to me we hire you for a job of a purchaser.
I agreed to this post and he told me that you have to pay visa money in advance. The money he invited me to his Pakistani friend's account.
I sent the full amount to the account listed and given by him in Pakistan. Instead of giving me a work permit he gave me a visit visa.
I worked for him for one & half month and my visit visa was also for one month and my visa period has expired.

س: كيف يمكن أن أطالب بمستحقاتي المالية قانونيًا من نادي رياضي قمت بإعطاء حصص رياضية فيه بصفة موظفة مستقلة بدون أي عقد كتابي، علمًا بأن النادي لم ينكر وجود مستحقات لي لكنهم لم يدفعوا أي جزء من المبلغ.
هذه المستحقات تشمل بعض الأشهر من أعوام 2018 و2019 وبداية 2020. قمت بمراجعتهم أكثر من مرة، وفي كل مرة يعدوني أن أستلم في الشهر المقبل.
مضى على هذا الكلام ما يقارب 6 أشهر علمًا بأنني لست المدربة المستقلة الوحيدة في النادي التي لم تستلم مستحقاتها، والمقلق الآن أن النادي بدأ يتعلل بمروره بضائقة مالية بسبب أزمة فيروس كورونا.

لم أوقِّع العقد مع الشركة ولكن اشتغلت لديهم مدة شهرين ولم يدفعوا لي راتب أبدًا.
هل يمكن المطالبة بالراتب غير المدفوع للشهرين؟
علمًا بأنني أمتلك دليلاً على أنني اشتغلت لديهم بالشركة.

Ministerial Decree No. (766) of 2015 On Rules and Conditions for Granting a Permit to a Worker for Employment by a New Employer 3
By this Decree Ministry of Labour of the UAE has removed the six-month labour ban for those who changed the job before completing two years of service. Labour ban will be still applicable for workers that qualify for skill level 4 and 5 under various circumstances.

Can an employer post an employee's photo on social media, LinkedIn or Instagram, without the employee's consent?
Secondly, the employer is forcing the employee to update the company details in the employee's profile.
I believe LinkedIn and Instagram are personal profiles and one cannot be forced to update the details. This photo was taken in the office.
