تحديد الأضرار والمطالبة بالتعويض في قضية اعتداء جنائية

Hi there,
Instead of focusing on the "damage amount" you should carefully get all the charges framed at this stage of the case.
After the judgement from the criminal court and as per the penalty, you can then file a civil case for the proper damages/compensation.

Hello,
You have to base your compensation on a proved damage that you suffered from the incident. If you suffered from a physical injury, you can calculate your pain and suffering compensation by either:
1- calculating your total hospital fees (even if paid by your insurance), and any unpaid days off you took from work because of the attack and multiply the number by 1 to 5 according to how severe your injuries were or your emotional trauma caused by the incident.
2- calculate the days it took for you to recover from the physical injury and the number of days to recover from the trauma and specify an amount, e.g. AED 250 and multiply it by the number of days.
You can include in your claim as well the amount of any other damages, e.g. the attacker damaged your car. As well as all legal and court fees you paid.
You can file a case, but you should have a medical report from the hospital about your health.
When the case is brought before the court, you can ask for compensation especially if the evidence is strong that the accused has committed the offence.
The court can also approve the request for the financial compensation you request.
But sometimes the judge adjusts the financial claim and has the freedom to decide the amount of compensation.
