تسوية الديون المعلقة والعودة إلى الإمارات
أنا مواطن أمريكي عليّ ديون كبيرة في الإمارات بعد مغادرتي لأسباب صحية. حيث إنني تعرضت لإصابة تتطلب إعادة تأهيل. لا أحب الطريقة التي غادرت بها الإمارات. وهذا يُقلقني.
إنني أفتقد إخواني وأصدقائي في المنطقة. أرغب في العودة للوفاء بالتزاماتي. ولكن بسبب الخوف من الاعتقال، لا يمكنني التفكير في الإمارات باعتبارها موطن لي بعد الآن.
ومع ذلك، إذا أُتيحت لي فرصة العمل مرة أخرى في إمارة دبي، هل يمكنني إعادة التفاوض حول وضع شروط جديدة لتسديد القروض من شأنها أن تسمح لي بالعودة؟
وبالتالي، تسديد الديون المستحقة علي وإرضاء رغبتي بفعل ما هو صحيح؟

كان راتبي في الإمارات كبيرًا حيث كان يزيد على 47 ألف درهم شهريًا. وسيمنحني العقد الجديد أكثر من ذلك.

Thank you for reaching out to me on this.
I completely understand your situation and also no one wishes to leave the country this way but circumstances are not in our control.
Legally speaking, the bank has two options to deal with your debt i.e. Criminal and Civil.
Criminal- The bank might be holding your security cheque considering you have taken a loan/ credit card.
Due to non-payment, the bank would have bounced your security cheque and filed a police case against you, resulting in a travel ban and pending arrest warrant.
To overcome this situation, you must first inspect the police records to ascertain the situation, appoint a legal representative via a power of attorney to represent you and dispose of the criminal case by paying fine (not pay the full debt).
Once the criminal case is disposed of, your travel ban and pending arrest warrant are lifted and you can safely return back to the UAE.
Civil- The bank can file a civil case against you before the civil court to recover the debt on the basis of account statement and agreement.
There is no arrest or travel ban in the civil case, however, once the judgement is pronounced, there will be a travel ban.
Once, the criminal case is disposed of, you can actually negotiate and settle with a bank for a discount on the debt owed.
The reason I say this is because till the criminal case is ongoing, the bank will hold leverage and will not renegotiate.
