Cancellation of labour contract for delay in salary
Dear Sir,
I have a query relating to the cancellation of labour ban on grounds that the company is delaying the salary almost 59 days (1-day short) two months.
It has become a habit of the company to delay the salary every month. I would seek the following information:
- What are the criteria for breaking the contract on grounds of delay in salary in case I apply for cancellation on the basis of delay in salary?
- Shall I have to pay 45 days salary or no?

Thank you for getting in touch with me on this.
Please note that if you are facing issues with salary for more than 60 days, then you are entitled to file a labour case to cancel your labour contract, claim salary and three months additional salary as compensation.
Since the case is filed due to delay in salary, you are not obliged to pay the employer 45 days of salary.
