عدم تجديد عقد العمل عند انتهاء مدته

طاب يومكِ يا سيدتي،

أنا أعمل في هذه الشركة منذ أربع سنوات وشهرين. لقد أرسلت خطاب الاستقالة الخاص بي عبر البريد الإلكتروني مساء يوم الخميس، وهو عطلة نهاية أسبوع.

لكنني قمت بحساب فترة الإشعار لمدة شهر واحد بدءًا من يوم الأحد فصاعدًا. هل هذه الاستقالة صالحة ومقبولة من الناحية القانونية؟

هناك معلومة هامة أخرى؛ انتهى عقدي السابق في 20 يناير 2019. بعد ذلك لم أوقع على أي عقد آخر.

حتى الآن، لا يوجد عقد سارٍ. هل ما زلت خاضعًا لشروط وأحكام العقد السابق؟

Thanks for writing to me.

I assume yours is a limited period contract. I understand that your contract expired in January and you wish not to renew the contract.

Please note that since your contract has already expired, there is no requirement to serve a notice period.

Article 1(I)(1) of the Minister of Labour's decree no. 765 of 2015 on rules and conditions for the termination of employment relations states:

"An employment relationship between an employer and employee may be terminated in the case of fixed-term contracts (approved by the ministry for a term of no more than two years). An employment relationship is terminated if the contract expires and the contract is not renewed."

You may inform the employer that you are not interested to renew the contract any further and request him to cancel the residence visa. Your benefits will be calculated on the basis of your last contract.
