العواقب المترتبة على الاستقالة خلال فترة الاختبار

إنني أعمل في وظيفة مهارية من الفئة الأولي في إحدى الشركات بإمارة دبي، بموجب عقد عمل محدد مدته عامين. فترة الاختبار مدتها ستة أشهر.

إذا كنت أرغب في ترك وظيفتي الحالية خلال فترة الاختبار التي تبلغ مدتها ستة أشهر للحصول على وظيفة أخرى في شركة أخرى (وظيفة مماثلة، ولكن أجر أعلى، وشركة أفضل وأكبر، وإمكانيات مستقبلية أفضل).

ماذا ستكون العواقب المترتبة على ذلك من جانب صاحب العمل الحالي أو من جانب حكومة دولة الإمارات؟

أيضًا، ما هي مدة فترة الإشعار التي يجب أن أقضيها؟ وهل هناك احتمال لفرض حرمان من أي نوع؟

لقد دفع صاحب العمل الحالي مقابل استقدامي من الخارج وأيضًا كافة نفقات استخراج التأشيرة الخاصة بي.

According to your query, kindly go first through your contract clauses carefully before you leave the current job.

Based on your query, It is presumed that your employment is subject to provisions of the Federal Law No 8 of 1980 on the Regulation of Labour Relations (the "Labour Law").

Pursuant to your question, it may be noted that an employer is within its rights to seek compensation from an employee who may resign before the completion of the contract period, and the same applies even if the termination should occur during the probation period.

The provisions apply only to contracts of limited period. This is in accordance with the provisions of Article 116 of the Labour Law, which states:

"Where a contract is revoked by the worker for reasons other than those specified in article (121), he shall be required to compensate the employer for any prejudice the latter sustains as a result; provided that the amount of compensation shall not exceed half the worker's remuneration for three months or the residual period of the contract whichever is shorter unless the contract contains a provision to the contrary."

If you break the limited contract by resigning from your job, you may get a labour ban that could last up to one year. The UAE Labour Law stipulates a minimum notice period of 30 days or one month.
