عدم دفع الشركة للمستحقات بعد الإنهاء التعسفي

السلام عليكم،

لقد تم نقلي للهند من شركتي في دبي في 1 يناير 2019، وتم إخباري بأنه سيتم الانتهاء من التسوية قبل مغادرتي كما ذُكر في خطاب النقل.

ومع هذا فقد أعطوني 50% من التسوية، ولم يدفعوا مرتبات شهري يناير وفبراير حتى الآن.

بنهاية شهر فبراير، قاموا بإرسال رسالة إنهاء التعاقد، ومنذ ذلك الحين وأنا أتابع التسوية المُعلقة كما وُعدت، ورواتب الشهرين المعلقين.

أريد أن أعلم ما هي الإجراءات التي يمكنني اتخاذها هنا، حيث أنهم نادرًا ما يردون على رسائل البريد الإلكتروني من طرفي وعندما يردون فإنهم يعطونني وعودًا كاذبة.

Thank you for reaching out to me on this.

Please note that you should file a labour complaint against the company for not paying your salary and terminating you without notice period.

As per the Labour Law, you are deemed to be terminated since you were not paid for more than two months (Jan and Feb).

Such termination is Arbitrary in nature for which the Labour law awards up to three months of salary towards compensation.

I would advise that you come to the UAE and file a labour complaint against the company for your pending salaries, notice period salary, three months salary for compensation, gratuity and pay leave, if any.

If one-year lapses from the date of your termination, then you will lose all your rights hence I would urge you to file a case as soon as possible to claim your rightful dues.
