Questions & Answers
What do I need to file a case against my tenant for failing to provide rent cheques after a legal notice?
I'm looking for a potential opening of an RDC lawsuit for my tenant. She is not providing rent cheques, even though we agreed and renewed the tenancy contract.
There is also an overdue of the 1st cheque payment. I sent a legal notice on non-payment, served on her on 16th September.

Hello,
First, we need to ensure that your legal notice is valid and delivered correctly with proof of delivery.
If the notice is valid and the tenant fails to pay within the 30-day payment period from September 16, you can file an eviction case with the Land Settlement Department for non-payment and claim all arrears, rent due until full delivery, and court fees from the tenant.
Please provide me with the notice, proof of delivery, the renewed contract, my lease, and the check schedule so I can review and provide you with accurate guidance.
