Right to accept a new job offer after accepting and signing the one before
Hello,
I am in Dubai and I have got a labour offer letter from a new employer (XYZ). In the interim of cancelling the current employment visa, I have got another offer with a good raise in salary from (ABC).
Now, is it mandatory that I have to join the company from which I have got labour offer letter and we have signed, or can I go ahead with the 2nd offer which has been made to me?
Dear Questioner,
Please note that signing as accepting an offer letter is legally considered as accepting the employment offer. So, it can be considered as a contract in theory.
However, I cannot really give you a solid answer before seeing such a document how it is structured, and what kind and limits of liability you have agreed to.
In practice, such letters and initial agreements can be withdrawn if the new company (XYZ) take the withdrawal and do nothing about it.
In some cases, such withdrawals can have a great effect on such companies like for example in the case that they have terminated someone else or affected a replacement plan based on such acceptance you made.
The company has the right to claim compensation for such damages in this case if they are able to provide a proof. Such case will be a civil case and will not fall under the labour court jurisdiction.
